FELA was enacted in 1908 in response to the high number of deaths that occurred in the railroad industry. In addition to providing a compensation scheme for railroad workers, FELA encouraged the railroad industry to promote safer work practices. In the 100 years since the law was passed, its provisions have not changed significantly.

FELA requires proof that the injury to the worker was caused, in whole or in part, by the negligence or fault of the railroad through the conduct of another railroad employee, agent or contractor. FELA uses the doctrine of comparative negligence. An employee who was negligent may still recover for his or her injuries but the award is reduced by the percentage that the employee's own negligence contributed to the injury.

A worker who brings a successful claim can recover the following damages, generally payable in a lump sum award:

  • Lost wages (past and future);
  • Medical expenses not covered by insurance provided by the railroad and not already paid by the railroad;
  • Pain and suffering (past and future);
  • Permanent injury;
  • Emotional distress.

In addition to allowing an injured employee to sue his or her employer for damages, FELA regulations require that the railroad work environment be free of safety hazards and unsafe conditions. Employers must regularly inspect the workplace and warn employees of potential dangers, even in circumstances where the employee should be aware of the dangers. FELA regulations also require employers to adequately train all employees, provide sufficient supervision and assure that safety regulations are followed.

Because it may be difficult to determine the complete circumstances surrounding a workplace railroad injury, you should consider having your case evaluated by an attorney. The Morristown injured railroad worker attorneys of Terry, Terry and Stapleton have extensive experience representing railroad workers in FELA litigation. We will work to protect your rights and to ensure that you receive all of the compensation to which you are entitled.
